  Standards for Offender Chemical Abuse Testing  
 

Purpose
This procedure will outline the steps, forms and responsible persons required to conduct on site chemical abuse testing on offenders sentenced to Oklahoma County Community Sentencing Division.

Introduction
Chemical abuse testing is an effective tool in monitoring illegal drug usage, therefore holding the offender accountable and to encourage a drug free lifestyle.

On site chemical abuse testing performed by CS probation officers will be conducted only on Moderate Level (LSI score 19-28) offenders and the results will be used for court sanctions only, if necessary, and are not allowed to be used in the revocation process.

Probation officers conducting chemical abuse testing will receive training prior to testing. Training may consist of video instruction provided by the manufacturer along with verbal and hands on instruction by a designated employee.

Procedure

  1. Offenders sentenced to the CS will have an initial chemical abuse test conducted within the first 30 days of supervision.

    An On-Site chemical abuse test may be performed only on Moderate Level offenders. Low/High Level offenders will be referred to test sites within the community.

    All offenders sentenced for drug related offenses and/or when the probation plan stipulates substance abuse treatment will have a chemical abuse test completed a minimum of one time per month for the first three months of Community Sentencing supervision.

    After the initial three (3) months of Community Sentencing supervision, chemical testing will be performed at least quarterly unless the officer decides additional chemical testing is needed. A positive chemical test should result in an increase in chemical testing by the officer.

    If a Moderate Level offender tests positive for illegal drug usage using the On-Site chemical abuse test, the officer will provide the offender with a voucher to a contracted provider for re-testing. The offender will be instructed to report to the contracted provider the same day and tested for the illegal substance that reacted positively to the On-Site test given in the CS office. For those positive tests that occur after 3:00 PM, the offender will be instructed to report to the contracted provider, no later than 12:00 noon the next business day for re-testing. Only a positive test from a contract provider will be used in the revocation/acceleration court process.

    The offender’s failure to report for the re-test will result in additional sanctions or reported violations by the officer.

  2. The process for conducting the On-Site Testing will be as follows:

    1. Urine collection will be observed by an employee of the same gender only. Under no circumstances will an employee not of the same gender of the offender collect a urine sample for testing. Only a Probation Officer (PO) is allowed to conduct chemical abuse testing.

      1. The PO will obtain a urine collection/test kit.

      2. The CS urinalysis log will be completed and initialed by the PO. The PO will ensure the instrument/test has the collection date/time, offenders name and DOC number written on it.

      3. The PO will note if the offender is currently taking any prescribed medications or over the counter medications. All prescribed medications will be verified by a probation officer.

      4. Collection of the urine sample will be performed in a restroom of the offender’s gender and observed by the same gender employee by a direct line of sight. No other area is allowed for the collection of urine samples.

      5. The PO will provide the offender with a new urine specimen collection container and instruct the offender to submit a sample that fills the container approximately half full. Under no circumstances will a specimen cup be re-used.

      6. All POs must wear protective latex gloves when performing the on-site chemical abuse testing. After an employee has collected the urine sample, the PO will insert the testing instrument/card into the specimen for 10 - 15 seconds. The PO will ensure the urine has been absorbed into the testing instrument/card as shown in training.

      7. The PO will have the offender appropriately dispose of the collected urine and deposit the container it in the trash receptacle.

      8. The PO will replace the provided cap on the testing instrument/card.

      9. The PO must read the testing instrument/card within 10 minutes and no later then 15 minutes from the time the test was started

      10. A photocopy of the test instrument/card will be made by placing the instrument/card in a clear plastic bag and photocopied. The photocopy of the positive test will be placed in Section 6 of the offender’s file.

      11. The PO will complete the urine analysis log immediately after the contact with the offender has been completed.

      12. An entry will be completed in the chronological record of the file. The entry will be coded in the chronological as UA and will include the date and time of the test, test results, and the name of the employee collecting the specimen.

      13. If the offender is receiving substance abuse treatment and the UA is positive, the supervising officer will notify the assigned counselor about the test results.

      14. A positive UA test will result in the PO administering additional sanctions and the possible issuance of a violation report.

      15. Note: All pregnant offenders receiving a positive reaction to a UA test will be referred to the Unit Manager for an immediate case conference.

  3. The Unit Managers will provide copies of all on-site Oklahoma County Community Sentencing Logs to the Director at the end of the month. These reports will be used for statistical analysis and billing purposes.
