Oklahoma County Grand Jury Takes No Action in OCPD Use-Of-Force Case

OKLAHOMA CITY – A newly empaneled Oklahoma County Grand Jury met last week to review an Oklahoma City Police Department use-of-force case resulting in the death of Jose Martinez.

On June 4, 2025, Oklahoma City police were serving a sex crimes related search warrant at a residence in the 5200 block of Evanbrook Terrace. During service of the search warrant, Jose Martinez armed himself with a gun and fled the residence on foot, into a wooded area. An officer ordered Martinez to stop but Martinez ignored the commands, tossed his gun over a fence and hopped over. An officer already on the other side of the fence saw Martinez picking up the gun. As Martinez started toward the officer armed with the gun, he was shot. Martinez was pronounced dead at the scene. No one else was injured.

At the time of the shooting, investigators had been searching for Martinez for more than a week regarding arrest warrants issued for him for three counts of first-degree rape and one count of forcible oral sodomy.

The Grand Jury heard from three detectives and viewed 16 exhibits which included evidentiary items such as body-worn camera, photographs from the scene and a recorded interview with the officer involved. One detective testified about the basis of the search warrant and arrest warrant for Martinez. Another detective testified about the interviews that were conducted during the investigation into the case against Martinez.

Members of the Grand Jury did not believe a use-of-force expert would aid in their deliberations. After reviewing the evidence and hearing testimony, the Grand Jury concluded that the matter was a no bill, meaning they didn’t believe the officer involved should face charges related to this incident.

ABOUT THE GRAND JURY

The Oklahoma County Grand Jury was convened in May 2025. The grand jury has the power to inquire into all offenses that occur in the county and either indict or no bill the offending individual. Grand jury proceedings are confidential by law. Title 21 Section 583 states:

Every grand juror, district attorney, clerk, judge or other officer who, except when required by a court, willfully discloses any evidence adduced before the grand jury or anything which he himself or any member of the grand jury may have said, or in what manner any grand juror may have voted on a matter before him, is guilty of a misdemeanor.”
